Beyond the Numbers: What Today’s AQI Tells Us About Environmental Justice

This article is written by Advocate Shivank Vikram Singh, an author at Lexful Legal, who regularly contributes legal insights and analysis on contemporary legal issues.

Introduction

The air we breathe is really important to us. The number 590 is not any number. It is a number that means something to the air we breathe. Why do we say that 590 is not a number?

The answer is that the air we breathe is affected by this number. The air we breathe is something we need to survive. We have to think about the air we breathe and how it is connected to the number 590. The air we breathe is what keeps us alive, so we should care about the number. What it does to the air we breathe.

It is January 19, 2026. For millions of people in India’s biggest cities, breathing deeply has become bad for their health. We often discuss air pollution as an environmental problem, but when you look out of your window and see a thick gray haze. Or feel that sharp pain in your eyes. Air pollution is not just a problem anymore. Air pollution is something that affects us directly.

Today, the air quality is not something you see in the weather. It is a sign that the laws that are supposed to protect people, like us, are being ignored without anyone saying anything. The air quality is a problem, and the laws that are supposed to protect us are not being followed.

The AQI: A “Check Engine” Light for Your Lungs

The Air Quality Index is like a thermometer that measures how bad the air is. We cannot see the particles like PM2.5 that are floating in the air around us. So the Air Quality Index takes science information and turns it into a simple scale with colors. The Air Quality Index makes it easy to understand how clean or dirty the air is. The Air Quality Index is a way to know what the air is like.

0 to 50 is a score. This means you can breathe easy. The air quality is fine when it is between 0 and 50. So if you see 0 to 50, you do not have to worry about the air you breathe.

101 to 200 is like a warning sign. If you have asthma, you will start to feel the asthma. You will know the asthma is acting up when you are in this range. The asthma will start to bother you.

When the air quality is really bad, like over 400, it is very severe. Even people who are usually very healthy will start to feel really bad and struggle.

Today, Delhi-NCR has a high number of 590. This is not just ba,d it is a problem. Delhi-NCR air is so bad that it has started Stage IV of the Graded Response Action Plan, which is also called GRAP. This means that people have to stop building things, and big trucks are not allowed to enter Delhi-NCR.

On the other hand, Mumbai has some 155. This is not as bad as the number in the north. It is still poor. In some areas, like BKC, the air feels heavy and dirty. Delhi-NCR air and Mumbai air are both bad. Delhi-NCR air is much worse.

The Promise vs. The Reality

We have a law called the Air (Prevention and Control of Pollution) Act, 1981. This law has been in place for more than 40 years now. The Air (Prevention and Control of Pollution) Act, 1981, was not something the government said we should do; it was a promise that the government made to us. The Air (Prevention and Control of Pollution) Act, 1981, gave the government the power to make sure the air we breathe is clean.

The government has to make sure the air is safe to breathe. They have to follow some rules to keep the air clean. These rules are like targets they have to hit. For Delhi, the target is to keep the air quality under 590.. When Delhi goes over 590, it is really bad. The government has not just missed the target; they have missed it by a lot. The air quality in Delhi is a problem when it hits 590. The government is supposed to keep the air clean and safe. They are not doing a good job when the air quality in Delhi reaches 590.

Stopping the Source (Sections 21 & 22):

Factories are not allowed to throw out smoke everywhere. They have to use filters, which are also called scrubbers. They need to get permits. The haze we see today is often because of factories not following these rules. Factories do this to save a bit of money. The haze is a problem, and it is usually caused by factories not using their filters and not getting the permits they need. Stopping factories from throwing out smoke is very important.

The Power to Act is really important. This is the part of the law that has some power. The Pollution Control Boards have the power to close down factories or turn off their electricity if the factories are making the neighborhood dirty and unhealthy. The Pollution Control Boards can actually do something to stop the factories from polluting the neighborhood.

The problem we have today is not that we do not have laws. The problem is that we do not enforce the laws that we have. We have laws. The laws are not being enforced. This is the problem that we are facing with the laws. The laws are there. The enforcement of the laws is what is missing.

It is more than a violation. It is your right when someone does something to you that they should not do. Your rights are very important. People need to respect them. When someone violates your rights, that is a deal. It is not a small problem; it is a major issue because it is your right that is being violated. People need to know that they have the power to stand up for their rights and say that something is not okay. Your rights are what keep you safe and protected, so when someone violates them, it is a violation of your rights.

The Supreme Court of India has made it very clear that the Right to Life, which is stated in Article 21, is not about being alive. The Right to Life is about living with dignity. You need to be able to breathe to have dignity. The Right to Life is a thing that every person needs. Without the ability to breathe, you cannot have dignity. The Supreme Court of India is talking about the Right to Life. What it means to really live.

The state is not doing its job when it comes to the Air Act. This is not about the environment. The state is also failing to protect the rights that are guaranteed to you by the Constitution.

When the air quality is really bad, it is a problem. Every day the air quality index is severe or poor, your fundamental rights are being taken away. The Air Act is supposed to help keep the air clean. The state needs to make sure it is enforced so that your rights are protected by the Air Act.

What can we do when we are in a spot? We have to think about what the problem is, and then try to find a solution. The thing is, we have to be very careful and think things through.

We can try to look at the problem from an angle and see if that helps us. What can we do to make things better? Sometimes we just have to take a step and think about what we are doing. We have to ask ourselves what we can do to fix the problem. What can we do to make things right?

It is easy to feel helpless when you look up at the sky, but the law gives us a voice to speak up. If you see a construction site that is ignoring the dust rules or a factory chimney that is releasing smoke into the air, you can report the construction site or the factory to the authorities. The law is there to help us and the environment, so we should use it to report things, like the construction site or the factory when they are not following the rules.

In Delhi, reach out to the DPCC.

In Maharashtra, contact the MPCB.

These agencies have to listen to your complaints and do something about them because that is what the law says. The law is in place. It is up to all of us to make sure the law is actually used. We need to make sure the law works for us, for the agencies, for our complaints.

The Bottom Line: Moving From Haze to Action

The air quality index is really bad when it is 590 or even 155. This is not a number, about the environment. It is a sign that our legal system is having a lot of problems. The Air Act of 1981 was made to protect our health. It was supposed to give us all the tools we need to keep the air clean.. When we wake up to another day of bad smog, it is clear that a law is only good if people actually follow it and make sure it is enforced. The Air Act of 1981 is a law that is supposed to help us. It does not seem to be working very well.

We need to stop thinking that bad air is something we have to deal with in the winter or when we live in a city. When the air we breathe is not good enough according to the rules made by our government, that is a problem. The air we breathe is not good enough when it does not meet these rules. By learning about these numbers and the laws that are in place, we can do something about it. We can stop standing by and doing nothing. We can be informed citizens who demand air. The Constitution promises us air, and we should get it. We should know about the air that the Constitution promises us and make sure we get it.

The fog might be thick today, but our legal rights are clear: we have the right to breathe.
